Terms of Service

1. Introduction

Welcome to JOYA ("the Platform"), operated by the team behind JOYA ("JOYA", "we", "us", or "our"). JOYA is an online marketplace connecting event vendors ("Vendors") with individuals planning celebrations ("Joyers") across Lebanon and the wider region.

By accessing or using JOYA — whether as a Vendor, a Joyer, or a visitor — you agree to be bound by these Terms of Service ("Terms"). If you do not agree, please do not use the Platform.

2. Definitions

• Platform: The JOYA website accessible at joyers.space and any related mobile or web applications.
• Vendor: Any business or individual who registers on JOYA to offer event-related products or services.
• Joyer: Any individual who uses the Platform to discover, save, or contact Vendors.
• Listing: A Vendor's public profile on the Platform, including their description, photos, packages, and contact information.
• Content: All text, images, videos, and other material uploaded to or published through the Platform.

3. Eligibility

To use the Platform you must be at least 18 years of age and have the legal capacity to enter into binding agreements under Lebanese law. By registering, you warrant that all information you provide is accurate, current, and complete.

4. Vendor Accounts

Vendors must submit an application for review. JOYA reserves the right to approve or reject any application at its sole discretion, without being required to provide reasons.

Upon approval, Vendors receive access to a personal dashboard to manage their Listing, upload photos, set packages, and view performance analytics. Vendors are solely responsible for the accuracy, legality, and completeness of their Listing content.

Vendors agree not to:

• Post false, misleading, or fraudulent information;
• Use the Platform to advertise services they do not genuinely offer;
• Solicit Joyers to take any action that circumvents JOYA's platform or misrepresents the Vendor's association with JOYA;
• Upload content that infringes any third-party intellectual property rights.

5. Joyer Accounts and Waitlist

Joyers may join a pre-launch waitlist by providing their name and email address. By joining, Joyers consent to receiving communications from JOYA regarding the Platform's launch and updates.

Joyers are responsible for maintaining the confidentiality of their account credentials and for all activities that occur under their account.

6. Platform Role and Limitation of Liability

JOYA is a marketplace platform only. We do not ourselves provide event services. JOYA does not process any payments or transactions between Vendors and Joyers. All commercial arrangements, negotiations, and payments are conducted exclusively and directly between Vendors and Joyers outside the Platform. JOYA is not a party to any such arrangement and bears no liability for the quality, safety, legality, pricing, or delivery of services discussed or arranged through the Platform.

To the fullest extent permitted by applicable law, JOYA's total liability for any claim arising out of or related to these Terms or the Platform shall not exceed the amount of subscription fees, if any, paid by the claimant to JOYA in the twelve months preceding the claim. For the avoidance of doubt, JOYA does not charge Joyers any fees. Vendors are offered free access to the Platform for a period of six (6) months following the official launch date, after which subscription fees may apply. JOYA will provide Vendors with reasonable advance notice of any fee changes.

7. Intellectual Property

All Platform design, branding, software, and JOYA-created content are the exclusive property of JOYA and are protected under Lebanese intellectual property law and applicable international conventions.

By uploading Content to the Platform, Vendors grant JOYA a non-exclusive, royalty-free, worldwide licence to display, reproduce, and promote that Content for the purpose of operating and marketing the Platform.

8. Prohibited Conduct

You agree not to use the Platform to:

• Violate any applicable Lebanese or international law or regulation;
• Transmit spam, unsolicited messages, or harmful code;
• Scrape, copy, or reproduce Platform data without written authorisation;
• Impersonate any person or entity;
• Attempt to gain unauthorised access to any part of the Platform or its infrastructure.

9. Termination

JOYA may suspend or terminate any account at any time, with or without notice, for breach of these Terms or for any conduct that JOYA reasonably considers harmful to the Platform, its users, or its reputation.

10. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Lebanese Republic. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts of Beirut, Lebanon, once JOYA is formally incorporated.

11. Amendments

JOYA reserves the right to amend these Terms at any time. Continued use of the Platform following notice of any amendment constitutes acceptance of the revised Terms. We will notify registered users of material changes by email.
